Things you need to know as a beneficiary

Who can be a beneficiary?

Landlords/Beneficiaries must be a legal entity such as:

  • A business entity with a valid Australian Business Number (ABN) or Australian Company Number (ACN);

  • An individual with a valid ABN; or

  • A government entity.

How can I make a claim on a bank guarantee?

Landlords/Beneficiaries can make full or partial claims:

  • Online by completing our Digital Claim Form; or

  • Offline by emailing or posting a completed Avenue bank guarantee claim form.

Alternatively, you can also make a claim by submitting a letter of demand. If you choose to submit a letter of demand, the following details must be included:

  • Company name, address and contact details of the beneficiary. If the beneficiary is an individual, their full legal name, mailing address and contact number.

  • The date the letter was signed (must be no older than 30 days).

  • Avenue Bank customer name as listed on the bank guarantee, including ABN/ACN.

  • Bank guarantee number and amount listed on the bank guarantee.

  • All named beneficiaries, including their ABN/ACN listed on the bank guarantee.

  • Beneficiary’s signature including full legal name and role in the company.

  • Certify the sum owing to the beneficiary by the named Avenue Bank customer and that the beneficiary demands payment of this amount.

  • Bank account details where payment will be made to including the account holder’s name, BSB, account number, and bank.

Important - If you are making a partial claim, you must provide instructions for the remaining guarantee amount:

  • No Further Claim - You must confirm and acknowledge that there will not be any further claims in respect of the bank guarantee and that it will be cancelled. You must also confirm and acknowledge that any remaining funds will be returned to the named Avenue Bank customer.

  • Further Claim – You must confirm and request that on receipt of the claimed amount, Avenue bank issues a replacement bank guarantee for the amount remaining, at which point the initial bank guarantee will expire.

Setting up your Standard Settlement Instructions

To minimise potential delays in the event of a claim and reduce the risk of fraud, we strongly recommend landlords/beneficiaries set up their standard settlement instructions with us. These instructions set out important information such as authorised representatives and nominated bank account details. Avenue will refer to these details in the event of a claim.

Each time a bank guarantee is issued, we invite the beneficiary to set up their standard settlement instructions. Not sure if you’ve provided instructions? Contact us now and set them up on 1300 283 265.

How do I know if my bank guarantee is authentic?

As a licensed Australian bank, we take security very seriously. If you suspect you have been provided a fake Avenue Bank Guarantee, you can always verify its authenticity with us by calling 1300 283 265.
